By accessing our website, placing an order, reserving equipment, renting equipment, or using our services, you agree to be bound by these Terms and Conditions.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into binding agreements to use our services or rent equipment from Tape And Reel Co.

You agree that all information you provide is accurate, complete, and current.

2. Services

Tape And Reel Co. provides camcorder, video equipment, media equipment, and related rental services.

All rentals are subject to availability and acceptance by Tape And Reel Co.

We reserve the right to refuse service, cancel reservations, limit quantities, or deny rental requests at our sole discretion.

3. Pricing and Payment

All pricing is subject to change without notice.

Reservations are not guaranteed until payment has been successfully processed and confirmed.

By providing payment information, you authorize Tape And Reel Co. to charge all amounts owed in connection with your rental, including but not limited to:

  • Rental fees

  • Late fees

  • Cleaning fees

  • Shipping fees

  • Repair costs

  • Replacement costs

  • Taxes

  • Collection costs

  • Any other amounts due under these Terms

Failure to pay amounts owed may result in collection activity or legal action.

4. Rental Period

The rental period begins upon pickup, delivery, or confirmed receipt of shipped equipment.

The rental period ends when all rented equipment has been returned to Tape And Reel Co. and successfully inspected.

Equipment returned after the agreed return date may be subject to additional rental charges.

5. Equipment Condition

All equipment is inspected prior to release.

The renter is responsible for inspecting equipment immediately upon receipt.

Any concerns regarding equipment condition or operation must be reported promptly.

Failure to report issues within a reasonable period after receiving equipment constitutes acceptance of the equipment's condition.

6. Responsibility for Equipment

The renter assumes full responsibility for all rented equipment during the rental period.

The renter agrees to:

  • Exercise reasonable care in handling equipment.

  • Follow manufacturer recommendations and operating instructions.

  • Protect equipment from theft, misuse, neglect, loss, or damage.

  • Prevent unauthorized use by third parties.

Equipment may not be sold, pledged, transferred, subleased, or loaned without prior written permission from Tape And Reel Co.

7. Loss, Theft, and Damage

The renter is responsible for any loss, theft, destruction, or damage occurring during the rental period.

In the event of loss, theft, or irreparable damage, the renter may be charged the full replacement value of the equipment, accessories, and related components.

Replacement value shall be determined by Tape And Reel Co. based on current market replacement cost, taxes, shipping expenses, sourcing costs, and administrative expenses.

The renter must promptly notify Tape And Reel Co. of any loss or theft and cooperate with any investigation or insurance claim.

8. Data and Recordings

Tape And Reel Co. is not responsible for lost, corrupted, damaged, inaccessible, or deleted recordings, photographs, audio files, memory card contents, or other digital media.

The renter is solely responsible for backing up and preserving all recordings and data.

Tape And Reel Co. makes no guarantee regarding the success of any recording, event capture, media project, or production.

Users are responsible for testing equipment prior to use.

9. Returns

Equipment must be returned on or before the agreed return date and time.

Returned equipment may be inspected for completeness, functionality, cleanliness, and damage.

Additional fees may be assessed for:

  • Missing accessories

  • Missing batteries

  • Missing chargers

  • Missing memory cards

  • Excessive cleaning requirements

  • Damage

  • Late returns

10. Shipping

If equipment is shipped, risk of loss transfers to the renter upon delivery.

The renter is responsible for following all return shipping instructions provided by Tape And Reel Co.

Tape And Reel Co. is not responsible for delays caused by shipping carriers, weather, or circumstances outside our control.

11. Prohibited Uses

You agree not to use our website, services, or equipment:

  • In violation of any law or regulation.

  • For fraudulent or deceptive purposes.

  • In hazardous conditions beyond manufacturer specifications.

  • In a manner that could reasonably result in damage, injury, or loss.

  • To interfere with the operation of our website or business.

12. Intellectual Property

All content on this website, including text, graphics, images, logos, branding, designs, videos, and software, is owned by Tape And Reel Co. or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, or used without prior written consent.

13. Chargebacks and Payment Disputes

Initiating a chargeback or payment dispute does not relieve the renter of obligations under these Terms.

Tape And Reel Co. reserves the right to pursue recovery of all amounts owed, including collection costs, attorney fees, court costs, and related expenses.

14. Limitation of Liability

To the fullest extent permitted by law, Tape And Reel Co. shall not be liable for:

  • Lost profits

  • Lost business opportunities

  • Lost recordings

  • Lost data

  • Missed events

  • Production delays

  • Travel expenses

  • Venue costs

  • Substitute equipment costs

  • Indirect, incidental, special, or consequential damages

In all circumstances, Tape And Reel Co.'s total liability shall not exceed the amount paid by the customer for the applicable rental transaction.

15. Indemnification

You agree to defend, indemnify, and hold harmless Tape And Reel Co., its owners, employees, contractors, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses arising from:

  • Use of rented equipment

  • Violation of these Terms

  • Injury, death, or property damage occurring during the rental period

  • Any misuse of equipment

16. Disclaimer of Warranties

All services and equipment are provided on an "AS IS" and "AS AVAILABLE" basis.

Tape And Reel Co. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted operation of equipment, websites, or services.

17. Force Majeure

Tape And Reel Co. shall not be liable for delays or failures resulting from events beyond our reasonable control, including but not limited to natural disasters, weather events, carrier delays, labor disputes, power outages, internet outages, governmental actions, or other unforeseen circumstances.

18. Governing Law

These Terms and Conditions shall be governed by the laws of the State of California.

Any dispute arising from these Terms, our services, or equipment rentals shall be brought exclusively in the state or federal courts located in Sacramento County, California.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Changes to Terms

Tape And Reel Co. reserves the right to modify these Terms and Conditions at any time.
